UOJ journalist's lawyer: Detention in SIZO cannot be extended automatically
The lawyer of Orthodox journalist Valeriy Stupnitsky urged the judge to oversee the legality of the accused's measure of restraint.
In the Kyiv Court of Appeals, the lawyer for UOJ journalist Valeriy Stupnitsky responded to a judge's remark that the court does not delve into the merits of the case or determine the guilt of the defendant, stating that this contradicts the norms of the European Court of Human Rights.
"Any extension of the term for a suspect cannot be quasi-automatic. Judicial oversight must be carried out in each case. Investigating judges must also examine the validity of the suspicions," the lawyer stated.
The defender explained why the measure of restraint in the form of detention in custody for the journalist is an unjustified compulsion. He reiterated to the court that the UOJ website did not publish materials justifying Russian aggression, and that criticism of the OCU does not constitute an undermining of Ukrainian statehood.
The lawyer requested an alternative measure of restraint for Valeriy Stupnitsky in the form of bail or house arrest.
However, the court left the journalist in custody.
