Frankivsk court annuls city council anti-abortion plea upon woman’s complaint
The court ruled that the city council had exceeded its powers.
The Ivano-Frankivsk District Administrative Court upheld the lawsuit of local resident Olha Kukula and annulled the decision of the city council, in which deputies called on the President of Ukraine, the Verkhovna Rada, and the Cabinet of Ministers to initiate constitutional amendments banning abortion. This was reported by Zaxid.net.
According to the court decision dated October 29, 2025, the plaintiff argued that the adopted appeal did not fall within the jurisdiction of a local government body, interfered with women’s rights, and was based on a letter from the Ivano-Frankivsk Archeparchy of the UGCC, which lacked a specific addressee.
Judge Andrii Mohyla, after reviewing the case materials, concluded that the city council had acted beyond its authority. The ruling states: “The right of legislative initiative in Ukraine is vested in the President, Members of Parliament, and the Cabinet of Ministers. Proposals to amend the Constitution do not fall within the exclusive competence of a city council.”
The court found the Ivano-Frankivsk City Council’s appeal unlawful and annulled it. The decision may be appealed.
The appeal in question was adopted by deputies on June 27. In it, the city authorities called for a constitutional ban on abortion, the restoration of the Ministry of Family Affairs, and the introduction of financial support for childbirth: 100,000 UAH for the first child, 200,000 UAH for the second, and 300,000 UAH for the third and subsequent children. The document was supported by 23 of the 30 deputies present at the session.
